    On February 28,
    1991, the Board split the docket in this
    proceeding and sent the Agency’s revised proposal to First
    Notice.

    On March 29,
    1991,
    the Illinois Environmental Regulatory
    Group,
    Illinois State Chamber of Commerce, Chemical Industries
    Council of Illinois,
    Illinois Coal Association, Illinois Farm
    Bureau,
    Illinois Fertilizer and Chemical Association,
    Inc.,
    Illinois Municipal League,
    Illinois Petroleum Marketers
    Association,
    and Illinois Steel Group
    (“Associations”)
    filed a
    motion for hearing in the above captioned proceeding.
    The
    Associations state that the Illinois Environmental Protection
    Agency has no objection to the motion.
    On April 5,
    1991,
    the
    McHenry County Defenders,
    Illinois Chapter of the Sierra Club,
    and Citizens for a Better Environment
    (“Defenders”)
    filed a
    response to the Associations’ motion.
    In response, the Defenders
    state they do not oppose the motion for hearing.
    It
    is also worth noting that Section 5.01 of the Illinois
    Administrative Procedure Act states in part:
    The agency shall hold a public hearing on the proposed
    rulemaking, during the first notice period in the
    following cases:

    (2)
    the agency receives a request for a public
    hearing, within the first 14 days after publication of
    the notice of proposed rulemaking in the Illinois
    Register,
    from 25 interested persons, an association
    representing at least 100 interested persons, the
    Governor, the Joint Committee on Administrative Rules,
    or a unit of local government which may be affected.

    The Associations’ motion was filed within 14 days of publication
    of First Notice.
    The Associations’ motion is hereby granted.
    Hearing will be
    set by separate Hearing Officer Order.
