    This matter comes before the Board

    the death

    respondent,
    to
    substitute
    the
    respondent’s estate as party respondent and to set this matter for
    hearing”
    filed
    by
    the
    Illinois
    Environmental
    Protection
    Agency
    (Agency).
    An affidavit of Proof of Service via certified mail on
    the attorney the Agency contends
    is executor of the respondent’s
    estate was attached to the motion.
    No response was filed by the
    respondent’s estate.
    The Hearing Officer assigned to this matter
    granted the motion.
    The Board hereby orders that the Agency provide the Board with
    confirmation of proof of service
    on the executor of respondent’s
    estate.
    Confirmation, such as a copy of the return receipt,
    is to
    be
    filed
    in the Board’s
    office by November
    27,
    1990.
    The Board
    also
    orders
    both
    parties
    to
    file
    comments
    on
    the
    issue
    of
    substituting
    the
    respondent’s
    estate,
    upon
    the
    death
    of
    the
    respondent,
    in an administrative citation proceeding.
    Such comment
    is to be filed in the Board’s office by December 11,
    1990.
    The Clerk’s
    office
    is
    ordered to
    serve
    this
    order
    on
    the
    executor of respondent’s estate via certified mail,
    return receipt
    requested.
