ORDER OF THE BOARD by

This matter comes before the Board on a regulatory proposal
filed on January
10, 1991 by the Illinois Environmental
Protection Agency
(“Agency”)
concerning the
PM10 emission limits
for the portland cement manufacturing plant ana associated quarry
operations located in LaSalle County,
Illinois.
The proposed
regulations are applicable to a single facility owned and
operated by Lone Star Industries in Oglesby, Illinois who is
in
agreement with the Agency’s proposed regulations.
Because the rule is federally required, the Agency has filed
several motions in order
to meet certain federal deadlines.
The
Agency states that each state is required to complete final
promulgation of regulations and submit a PM—10 SIP for federal
approval for all moderate areas by November 15,
1991.
On January
10,
1991 the Agency filed a motion for expedited hearings and a
motion for Board request for preliminary review by the Joint
Committee on Administrative Rules
(“JCAR’t). The Agency also filed
a request for determination that an Economic Impact Study not be
prepared.
Without ruling on the sufficiency of the Agency’s petition
or accepting this matter for hearing at this time, the Board
wishes to assure the Agency and all other interested persons that
the Board places a high priority on the quick resolution of this
proposal and will proceed as quickly as possible.
The Board
notes, however,
that it
is constrained by requirements imposed by
several statutes.
The Board grants the motions insofar as, at
this time,
the Board foresees no difficulty
in expediting the
hearing process and in making an early submission to JCAR.
