    ORDER OF THE
    BOARD

    This matter comes before the Board on Metcalf and Eddy
    Services,
    Inc.
    (“Metcalf”) motion for continuance.
    Metcalf seeks
    an extension of time from the Board’s November
    8, 1990 Order
    requiring it submit a filing by November
    27,
    1990 as to whether
    Taylorvilles’ October 22,
    1990 third party complaint is frivolous
    or duplicitous pursuant to Section 31(b) of the Illinois
    Environmental Protection Act.
    In support thereof, Metcalf states
    that it did not learn of the Order until November
    2,
    1990 and
    further, that
    it
    is an out of state corporation and will
    therefore need to secure local counsel.
    Accordingly,
    the Board grants Metcalf’s motion and the
    company will have until January
    4, 1991
    to file its 31(b)
    response.
