    ORDER OF THE BOARD (by C.A. Manning):
     
    On February 7, 2002, the Board, at the parties’ request, extended until April 30, 2002,
    the time period within which Midway Oil (Midway) may appeal a December 26, 2001
    determination of the Illinois Environmental Protection Agency (Agency).

    415 ILCS 5/40
    (a)(1) (2000); 35 Ill. Adm. Code 105.406. The Agency modified the proposed amended
    budget regarding Midway’s facility at 555 19th Avenue, Moline, Rock Island County.
    Because Midway failed to timely file an appeal, the Board dismisses this case and closes the
    docket.
     
    IT IS SO ORDERED.
