I concur in today’s Opinion and Order for the same reasons I
concurred on May 24,
1990.
There, and again today,
I believe the
Board should have simply issued and Order stating:
The Board hereby grants a variance consistent
with the
opinion
of the Appellate
Court
in
this matter.
Such an Order would have granted the necessary relief and avoided
much consternation.
