On September 30, 1991, the Agency filed a motion for a 60 day
extension of time in which to file its record in this matter.
The
Agency
seeks
the extension to
allow
it and Monsanto
to
pursue
negotiations, and the Agency further asserts that Monsanto has no
objection to its request.
Decision in this matter is presently due on January 11,
1992,
as no waiver of the decision deadline has been filed.
Accordingly,
the motion is denied.
However, should Monsanto decide to waive the
decision deadline,
the Hearing Officer
is authorized to grant an
extension of time for the filing of the Agency record in addition
to other extensions of time as previously authorized by the Board’s
set for hearing Order of September 26,
1991.
