    This matter is before the Board on cross—motions for dismissal

    (“Envirite”),
    Peoria Disposal Company and the Illinois Environmental Protection
    Agency.
    On September

    Respondent
    filed
    a
    motion
    for
    extension of time to
    file its motion to dismiss.
    Envirite also
    filed motions
    for extension of time to
    file its response to the
    motions to dismiss on September 23
    and
    29,
    1991.
    Envirite then
    filed its response, with an accompanying motion to file instanter,
    on October
    7,
    1991.
    All motions for extension of time and to file
    instanter are
    granted.
    Given the pendency of Envirite’s
    cross-
    motion for dismissal or summary judgment,
    respondents are granted
    until November
    10,
    1991 to file the appropriate responses to the
    cross—motion.
