This
matter
is
before
the
Board
on
Shell
Oil
Company’s
(“Shell”)
September
18,
1991
motion
to
modify
its
variance
compliance plan.
On November 29,
1990 this Board granted Shell’s
Wood River Manufacturing Company (“WRNC”)
a variance from 35
Ill.
Adin.
Code section 901.102(a)
and 901.103.
Shell submits that it
is committed to achieving noise reduction by the date set out
in
the variance (December 21,
1991), but that as work has progressed
on
its compliance
plan,
Shell
has
discovered that
a
technical
modification
will
be
necessary.
Accordingly,
Shell
seeks
to
substitute technically equivalent noise abatement measures pursuant
to 35
Ill. Adm. Code Sections 101.241 and 101.301(b).
Specifically,
Shell
proposes
to
alter
the
commitments
of
project number two found on page
6 of our November 29,
1990 Order.
The company will restore the forced draft fan system to operation
at the CR-3 unit in order to allow the natural draft plenums to be
closed.
This will silence the secondary burner noise at each of
the connected CR—3 process heaters.
Shell will leave the rest of
the preheat system,
including the indirect draft
fan,
idle.
The
company maintains that this alternative will provide a lower sound
level
from
the
CR-3
unit
than
the
compliance
plan
originally
proposed and
adopted by this
Board
because
the
dominant
noise
generating unit will remain off—line.
Shell
suggests
that
this
language
be
adopted
in
lieu
of
project number two found on page 6 of the Board’s November 29, 1990
order:

When
Shell
filed
this
motion
on
September
17,
1991,
the
company
requested
that the motion
not be
considered
until
our
October
10,
1991
meeting
in
order
to
give
the
Illinois
Environmental Protection Agency (“Agency”) adequate time to analyze
the proposed alternatives
and respond accordingly.
Although the
Agency
has
not
responded,
Shell
filed
a
motion
and
affidavit
stating’ that
the
Agency
had
no
objection
to
the
variance
modification.
Accordingly, this motion is granted.
