ORDER OF THE BOARD
(by M. NardullI):
This
matter comes
before the Board on Allied-Signal Inc.’s
(Allied) motion for extension of time to file chronic test report
filed on February 14,
1991.
The Agency has not filed a response
to Allied’s motion.
Allied seeks an extension of time to and including May
15,
1991 to
file a report detailing the results of certain chronic
toxicity testing required by the Board’s November 2, 1989 variance
order
as
modified
by the
Board’s
order
of
December
20,
1990.
Allied states in its motion that the amended variance order does
not
specify
a
date
by
which
the
report
must
be
filed,
but
recognizes that the report
“would have to be
filed
on or before
February 17, 1991, the date which the variance expires.”
As noted
by Allied,
this variance expired on February
17,
1991.
To the
extent that the chronic toxicity report must be filed as set forth
in the amended variance order,
the Board hereby grants A11ied’~
motion for extension of time to file this report to and includinc
May 15, 1991.
The report shall be filed with the Agency.
However
this order in no way extends the termination date of the variance.
IT IS SO ORDERED.
I,
Dorothy N.
Gunn,
Clerk of the Illinois Pollution Contrc
Board, hereby ce~ifythat the above Order was adopt~don the
