ORDER OF THE BOARD (by J. Anderson):
This petition, filed February 25, 1991, seeks variance from
35 Ill. Adm. Code 602.105(a) Standards for Issuance, and from 35
Ill.
Adm. Code 602.106(a), Restricted Status “only to the extent
those rules involve 35 Ill. Adm. Code 604.301(b)”. First, the
Board notes that, effective September 20, 1990, Section
604.301(b) was repealed. The standard at issue now appears in
Section 611.330(b). More importantly however, the only sampling
results presented by Petitioner are a 1984 letter from the Agency
indicating violation of the combined radium—226 and radium—228
standard of Section 611.330(a). Petitioner is directed to file
an amended petition which more clearly specifies from which rules
relief is sought, and which contains all sample results which
would tend to indicate violation of the gross alpha and/or
combined radium standard.
If an amended petition curing this deficiency is not filed
within 45 days of the date of this Order, this petition will be
subject to dismissal.
