This petition,

First,

the

Board notes

that, effective September 20,

1990,

Section

604.301(b) was repealed.

The standard at issue now appears

in

Section 611.330(b).

More importantly however,

the only sampling

results also indicate a violation of the gross alpha standard of

Section 611.330(a).

As a result,

Petitioner may also need a

variance from Sections 602.105(a) and 602.106(a) as they relate

to the gross alpha standard.

Petitioner

is directed

to file an

amended petition which more clearly specifies from which rules

relief

is sought.

If an amended petition curing this deficiency is not filed

within 45 days of the date of this Order,

this petition will be

subject to dismissal.
