ORDER OF THE BOARD (by J. Anderson)
This matter is before the Board on Halogenated Solvent
Industry Alliance’s (HSIA) motion to separate the consideration
of enviionmenta’~l effect from this rulemaking and motion to
reconsider the listing of tetrachioroethylene and
trichloroethylene as toxic air contaminants filed December 2,
1991; the response of the Illinois Chapter of the Sierra Club to
HSIA’s motions; the Illinois Environmental Protection Agency’s
motion for extension of time to answer HSIA’s motion regarding
listing filed December 9,1991; the Illinois Steel Group’s motion
for the Board to prepare an economic impact statement filed
December 12, 1991; the Illinois Environmental Regulatory Group’s
request for economic impact study filed December 11, 1991; arnl
the Illinois Department of Energy and Natural Resource’s response
to the HSIA motion filed December 16, 1991.
As an initial matter, the Agency’s motion for additional
time to file a response to HSIA’s request to reconsider the
listing of tetrachioroethylene and trichioroethylene as toxic air
contaminants is granted. The Agency is given, as requested,
until December 20, 1991, to file its response.
Regarding HSIA’s motion to sever the environmental effects
considerations from this rulemaking, the Board points out to HSIA
that it has already done so. Docket B has been previously
reserved for consideration of environmental effects. Docket B
was opened in the board’s second first notice opinion and order
dated September 26, 1991. HSIA’s motion either ignores or
miscomprehends this opinion and order. In any event, HSIA’s
motion is ill-founded and is therefore denied.
Finally regarding participants’ request that an EcIS be
prepared in the R90-l(C) subdocket, the Board reserves its
decision on this issue until a later date. The comment period
regarding the advisability of an EcIS expired December 12, 1991.
The Board’s decision deadline for this determination is January
20, 1992.
The participants are reminded to restrict their filings to
the proper subdocket: R90-l(A) for the toxic air contaminants
list, R90-l(B) for environmental effects consideration and R90-
1(C) for reporting requirements for emission sources.
