This matter conies before the Board on a April 26, 1991 motion

to withdraw filed by the Illinois Environmental Protection Agency

(Agency).

The Agency requests that this Administrative Citation

“withdrawn due to lack of

jurisdiction over the Respondent.”

In support

of its motion the Agency states

that service was not

obtained within sixty days of the site inspection

as required by

statute.

The Agency’s motion is hereby granted and this matter is

dismissed.
