    as
    dispositive of the facts in this administrative citation which was
    pending during the adjudication of the above mentioned case.

    case
    were
    not known
    at
    the time
    of
    the Board’s
    October
    11, 1990 Order.
    The Board
    grants
    the Agency’s motion.
    The Board
    Order
    of
    October
    11, 1990 is vacated and this matter is dismissed.
