    ORDER OF THE BOARD

    On March 11,
    1991,
    Calvary Temple Church
    (“Calvary”)
    filed
    an appeal of the Illinois Environmental Protection Agency’s
    denial of Calvary’s application for construction and operation of
    a wastewater land treatment system.
    The Board notes there are several problems concerning this
    appeal.
    First,
    there
    is a question whether this appeal
    is timely
    filed pursuant to Section 40 of the Environmental Protection Act
    (“Act”).
    Also,
    no copy of the denial letter was enclosed with
    Calvary’s petition.
    Additionally, the Board notes that the
    notice of filing accompanying the petition states that a request
    for expedited consideration was filed.
    However, no such motion
    with reasons was enclosed with the petition.
    Should Calvary want
    expedited consideration,
    it should submit an appropriate motion
    with reasons.
    Lastly,
    Calvary has not shown why this appeal,
    being an appeal of an Agency determination on remand,
    should be
    considered under the docket for Calvary’s previous permit appeal,
    rather than under
    a new docket.
    A copy of the Agency denial letter,
    an appropriate motion
    for expedited decision, and any other information necessary to
    address these concerns of the Board shall be received by the
    Board not later than March 26,
    1991,
    or this matter will be
    subject to dismissal.
    The Agency is also free to submit
    information on these issues within the same tixneframe.
