This matter is before the Board on its own Motion.
House
Bill 2491, presently awaiting the Governor’s signature,
amends
various provisions of the Environmental Protection Act as they
relate to potentially infectious medical wastes.
New Title XV:
Potentially Infectious Medical Waste includes several legislative
mandates for Board rulemaking.
One such mandate
is new Section
56.2(c), which requires that the Board “adopt regulations
in
accordance with Title VII of
the
Act prescribing standards and
criteria for transporting, packaging, segregating,
labeling,
and
marking potentially infectious medical waste”,
no later than
January
1,
1993.
The Board today opens this docket for the purpose of
conducting this rulemaking,
pending the Governor’s signature of
HB 2491.
Considering the time deadline and the fact that no
proposal for rulemaking exists,
the Board Orders that Inquiry
Hearings be set
in this matter.
