    filed a motion to
    dismiss.
    The motion is granted and this matter is dismissed.
    The Board notes that Safety-Kleen has requested dismissal
    “without prejudice”.
    Since the time for appeal of the permit
    under review has long since expired, the dismissal must be with
    prejudice.
