ORDER OF THE BOARD

On June 28,
1991,
Bloomingdale Partners, an Illinois Limited
Partnership, Howard Edison, Bruce NcClaren, and Gary Laken
(“respondents”)
filed
a motion for extension of time in which to
comply with the Board’s May
9,
1991 Interim Opinion and Order.
John and Jean Zarlenga
(“Zarlenga”) have not filed
a response to
the motion.
In their motion, respondents ask that the Board grant them
an additional
60 days (from July 30,
1991 until September 30,
1991)
to submit to the Board and the Zarlengas a report on the
methods of reducing or eliminating the noise pollution emitted
from One Bloomingdale Place.
In support of their motion,
respondents state that Bloomingdale Partners filed for voluntary
reorganization under Chapter 11 of the United States Bankruptcy
Code in the Northern District of Illinois on May 30,
1991, and
argue that the reorganization proceedings will delay compliance
with the Board’s Nay 9,
1991 Order-.
Specifically, respondents
note that Bloomingdale Partners must petition the Court to secure
approval for the retention of and payment to an expert to
investigate the sound emissions from One Bloomingdale Place and
draft the report, and that the Court must approve any proposed
remedial activity and expenditures as well as the retention of an
attorney to continue to represent the respondents in future Board
proceedings.
In light of the above, the Board grants the motion.
Respondents are directed to file their report with the Board and
the Zarlengas no later than September 30,
1991.
