This matter
comes before the
Board
on the August
12,
1991
motion to dismiss
filed by St.
Clair County.
On August
8,
1991,
the
Board issued
a default
order against the respondent,
Thomas
Hubbard.
The Board construes St. Clair County’s filing as a motion
for reconsideration of the Board’s default order.
In support of
its motion to dismiss St. Clair County states that the “respondent
had
in fact cleaned up the open dump cited in the Administrative
Citation.”
The Board hereby grants reconsideration, vacates its default
order of August
8,
1991 and grants the motion to dismiss.
