ORDER OF THE BOARD
(by J. Theodore Meyer):
This matter is before the Board on petitioners’ motion to
extend time to file their brief.
On June 3,
1993, the Board
accepted this case for hearing, but directed petitioners to file
a brief addressing the issue of standing.
That brief was to be
filed by June 17,
1993, with any response due by June 25,
1993.
Petitioners now seek to extend that June 17 deadline to July 2,
1993.
Petitioners state that they received the Board’s order on
June 7,
1993,
that their attorneys have been preparing appeals to
the appellate court and attending to a number of other matters,
that they have been as yet unable to obtain a necessary
affidavit,
and that they believe that there will be no harm or
prejudice to respondents or the Board by granting the motion.
Initially,
the Board notes that the response period for this
motion has not expired, but finds that waiting until the
expiration of the response period to grant the motion would cause
undue delay.
(35 Ill.Adm.Code 101.241(b).)
The motion to extend
time to file the brief
is granted.
Petitioners’ brief
on this
issue must be received at the Board’s Chicago office by 4:30 p.m.
on July 2,
1993.
Any response to that brief must be received at
the Board’s Chicago office by 4:30 p.m. on July 12,
1993.
Hearing in this case is scheduled for July 26 and 27,
1993.
This
schedule will allow the Board to rule upon the standing issue at
its July 22 meeting,
so that this
issue
is settled before
hearing.
IT IS SO ORDERED.
