This matter comes before the Board on a motion to extend the
Illinois Environmental Protection Agency’s
(Agency) response date
filed on December 31,
1991 by Illinois-American Water Company
(Water Company).
The Agency has filed no response to this
motion.
Section 106.714 of the Board’s procedural rules provides
that an Agency response to a petition for adjusted standard is
due 30 days after the filing of the petition.
Since Water
Company’s petition was filed on December 31,
1991,
the Agency’s
response under the procedural rule is due January 30,
1992.
It
is apparent that Water Company seeks to provide the Agency with
more information on its petition before the Agency files its
recommendation.
The Board grants Water Company’s motion to allow the Agency
an additional 30 days to file
its recommendation.
Since the
Agency has not replied to the motion, the Board deems that the
Agency has waived objection to granting of the motion.
(35 Ill.
Adm. Code 101.241(b)).
However, the Board recognizes that the
Agency may file its recommendation prior to the extended due
date,
should it desire to do so.
