This
matter comes before the Board on its own motion.
The
petition for adjusted standard was filed on September
4,
1991 and
contained a statement that Reynolds Metals Company reserved its
right to request hearings in this matter.
The petition was
accepted at the Board’s September 12,
1991 meeting.
The Illinois
Environmental Protection Agency
(Agency) moved to co—petition on
October 28, l99L
The Board granted the Agency’s motion on
November 7,
1991.
The petition requests relief from the Board’s air pollution
regulations governing emissions of volatile organic material.
This matter, therefore,
could result in a revision to the State
Implementation Plan
(SIP).
The Agency’s October 28,
1991 motion
states,
“Reynolds has sought a FIP revision from USEPA
reflecting the same technological position as submitted
to the Board.
USEPA is reviewing the material and
indicates
it
is approvable.
Because of Section 193 of the Clean Air Act Amendments
of 1990,
it is Region V’s position, however, that it
cannot approve a SIP from
Illinois which includes rules
less stringent than the FIP.
Therefore, USEPA must
first revise the FIP before Illinois can submit an
adjusted standard as a supplement to the SIP.”
One of the federal requirements for approval of a SIP
revision is that a hearing be held on the matter.
Therefore,
this matter is accepted for hearing.
The Board will defer
assigning a Hearing Officer
to this matter,
however, until
it
receives notice from the parties that the FIP has been revised.
The parties are directed to file status reports every 90
days,
the first being due in the Board’s office by March
2,
1992.
