ORDER OF THE BOARD (by J. Anderson):
On November 13, 1992, Cabot Corporation (Cabot) filed a
petition for variance from the requirement in 35 Ill. Adin. Code
730.168(d) (4) that owners or operators of Class I hazardous waste
injection wells run casing inspection logs at least once every
five years, and from the related requirements contained in
sections I.A(5), I.H(30)
(C)
(iv), I.H(30)(f), and I.H(30)(g) of
its underground injection control permit for well no. 2 at its
Tuscola, Illinois facility.
While the information provided by Cabot in support of its
petition generally meets the informational requirements of 35
Ill. Adin. Code 104.121, the petition contains certain
deficiencies or requires further clarification. Accordingly, the
Board directs Cabot to file an amended petition addressing the
following points:
1. Although there is an affidavit in support of the
material facts alleged in the petition, there is no
request for a hearing on the petition or, in the
alternative, a statement waiving a hearing as required
by 35 Ill. Adm. Code 104.124;
2. Cabot requests variance to postpone the removal of
tubing in well no. 2 until sixty days after well no. 3
is operational. Cabot states that it will take
approximately six months from the date of well no. 3’s
permit issuance before the well can be in operation.
Cabot should inform the Board of the date on which it
expects to receive the permit from the Agency.
Cabot is directed to file its amended petition on or before
January 3, 1993, or this matter will be subject to dismissal.
