ORDER OF THE BOARD
(by G.T. Girard):
On October 30,
1992, the Agency filed a motion for extension
of time
in which to file its Recommendation in this matter.
The
recommendation was due to be
filed
on November
6,
1992,
and the
Agency seeks
an extension through February
8,
1993.
In support
thereof, the Agency states that:
A related matter
is pending with the Agency.
Discussions regarding this related matter may
resolve the need for a variance.
Dietzgen has
filed
a waiver
of
the decision
date.
Also,
Dietzgen’s
attorneys
have
represented
that
they would not object to an extension to file
the Recommendation.
No one will be prejudiced
by this extension.
Further,
an extension may
create more efficient use of resources as this
matter
may
ultimately
be
dismissed.
Therefore,
to
allow
the
parties
sufficient
time
to
discuss
and
possibly
resolve
this
matter, an extension until February
8, 1993 is
necessary.
The Agency’s motion is hereby granted.
The recommendation is
now due to be filed on or before February 8,
1993.
IT IS SO ORDERED.
