    ORDER OF THE BOARD

    This matter is before the Board on petitioner Ideal Heating
    Company’s November 16,
    1992 motion to file a stipulation of
    facts, executed
    in counterpart.
    The stipulation is filed in
    anticipation of the filing of a motion for summary judgment.
    The
    motion
    is granted.
    The Board notes that the stipulation of facts seems to imply
    that the anticipated motion for summary judgment will be filed
    with the hearing officer.
    The Board reminds the parties that the
    hearing officer does not have authority to rule upon a
    dispositive motion.
