ORDER OF THE BOARD

On November 13, 1992, the parties filed a joint status report.
The report, due to be filed November
1,
1992, was accompanied by a
motion for leave to file instanter, which is hereby granted.
The parties report that soil sampling and analysis continues
in this case, in which the remaining issue is the appropriate RCRA
clean closure objective for the parameter cadmium.
The parties
note that a written report of soil investigation results, which was
due November 1, was delayed but is expected “shortly”, after which
they
expect
to
conduct
additional
settlement
negotiations.
Subsequently, the parties “intend to either reach agreement or to
request a date for hearing before the Board”.
The
status
report
stated
that
the
decision
deadline
was
February
27,
1993.
However, on November
18,
1992 Heico filed
a
waiver to June 28,
1993.
The
parties
appear to
be making
satisfactory
progress
in
pursuing
settlement
of
the
remaining
issue
in
this
case.
The
parties are directed to file an updated status report on or before
February 22,
1993.
