ORDER OF THE BOARD

This matter
comes before the Board
on
its
own
motion.
A
default order was issued in this administrative citation on October
24,
1991.
The
Board
then
received
a
letter
from
respondents
requesting
leave
to file
a petition for review.
On December
6,
1991,
the Board construed this letter as a’motion to vacate
the
default
order and directed the Agency
to file a response.
The
Agency
filed
a
response on January
6,
1992 requesting
that the
Board deny the motion to vacate.
The Board’s December
6,
1991 order also reviewed the Act’s
adminstrative citation provisions and informed the respondent that
further costs
could
be
incurred
as
a
result
of petitioning
for
review.
Lastly, the Board
stated that if
it did not hear from
respondent
by
a
date
specified,
the
Board
would
dismiss
respondent’ s motion.
Respondent did not file the requested statement with the Board
within the time allowed.
The Board hereby denies the motion to
vacate.
This matter is closed.
