This
matter
is
before
the
Board
on
respondent
Laidlaw
Waste
Systems,
Inc.’s
(Laidlaw)
February
16,
1993
motion
to
release
exhibits.
Laidlaw
asks
that
the
Board
release
certain
large
exhibits
introduced
by
Laidlaw
in
support
of
its
landfill
siting
application
so
that
it
may
use
the
exhibits
in
a
presentation
to
Laidlaw
personnel
in
late
February
or
early
March.
Laidlaw
notes
that
C.O.A.L.’s
35-day
time
to
appeal
the Board’s
decision
expires
on
February
25,
1993,
that
there
are
regular
size
duplicates
of the
large exhibits in the record, and
that,
if C.O.A~L.appeals,
the
exhibits can
be
returned
to
the
Board.
While
the
35-day
reconsideration
and
appeal
times
expire
today, C.O.A.L. could timely seek Board reconsideration or judicial
review by mailing its motion for reconsideration or petition for
review on February 25,
1993 such
that the
Board
may
not yet have
notice of the reconsideration or appeal.
The Board
is responsible
for maintaining the record and, consequently, will not release any
part of that record until it is established that there will be no
appeal.
Therefore,
at this
time,
Laidlaw’s motion
is denied.
However, no earlier than seven days
from
the date of this order,
Laidlaw
may,
by
written
letter
to
the Clerk of the Board, request
release
of
the
exhibits.
Upon receipt
of
such written
request
and
verification
that
there
is
no
appeal,
the Clerk
shall
release
the
Oversized
exhibits.
