ORDER OF THE BOARD (by J. C. Marlin):

On February 22, 1993, Safety—Kleen filed a status report in

accordance with the Board’s January 21, 1993, order. On February

23, 1993, the Illinois Environmental Protection Agency (Agency)

also filed a status report in accordance with the Board order.

Safety-Kleen reports that on February 8, 1993, it provided

comments on suggested documentation to the Agency in order for

the Agency to complete its documentation requirements. Safety-

Kleen also reports that it anticipates that the Agency will

complete its review of Safety—Kleen comments within the next few

weeks. Safety-Kleen anticipates that once the Agency has

informed Safety-Kleen of its final documentation needs that

Safety-Kleen will voluntarily withdraw this appeal.

The Agency states in its status report that it expects to

review the comments provided by Safety-Kleen within forty-five

days and hopes to conclude its negotiation with Safety-Kleen at

that time.

The parties are directed to file an updated status report on

or before April 12, 1993.
