This matter
is
before
the Board
on
its
own
motion.
On
February 4,
1993,
the Board ordered the parties to file a status
report
in this permit
appeal
initially
filed with the Board on
November 11,
1990.
The status report was to be received by the
Board no later than February 18, 1993 or this case would be subject
to dismissal for want of prosecution.
The parties have failed to
file a status report as ordered.
Previously, the parties failed to
comply with a similar status report order entered on December 17,
1992.
Therefore,
consistent with the Board’s February
4,
1993
order,
this
case
is dismissed for want
of prosecution
and the
docket is closed.
IT IS SO ORDERED.
Section 41 of the Environmental Protection Act (415 ILCS 5/41
(1992))
provides for the appeal
of final Board orders within
35
days.
The Rules of the Supreme Court of Illinois establish filing
requirements.
