Pursuant to the Board’s order of January
7,
1993, on
February
8,
1993 Safety Kleen filed a status report.
The report
states that on December 11,
1992,
the parties met to discuss a
resolution of the issues underlying the above-captioned closure
appeal.
As
a result of their meeting, the parties believed they
have developed a conceptual agreement for resolution of this
matter and similar closure appeals at other Safety-Kleen
facilities in Illinois.
The report notes that at this time,
the Agency is finalizing
its comments on the form of submittals the Agency would like the
Petitioner to make to document the implementation of the
agreement reached between the parties.
Once the Agency has made
these determinations,
Safety-Kleen sates that the parties will be
in a position to resolve this matter and dismiss this appeal.
The parties also plan to use the same framework and forms of
documents
to resolve the pending closures appeals for Safety-
Kleen’s Pekin facility
(PCB 92-29), the Schaumburg Facility (PCB
92—136)
and Arlington Heights
(PCB 92-126).
The parties anticipate that the Agency will finalize the
form of the subxnittals it will require within the next several
weeks.
Safety-Kleen will provide the Agency with comments as to
the IEPA proposed documentation during the week of February 8,
1993 and anticipates that these matters will be resolved soon
thereafter.
The parties are directed to file another status report on or
before March 25,
1993 concerning the status of this matter and
the related matters.
