This matter is before the
Board
on the Illinois
Environmental Protection
Agency’s
(Agency) January
7, 1993 motion
.to extend time to file its record. The motion states that
the
record is currently due on January 21, 1993,
that
the attorney
for petitioner Central Can Company has submitted a waiver
of the
decision deadline and is not opposed to the request for extension
of time, and that an extension is necessary to “ensure a thorough
and complete record.” Thus, the Agency
asks
that the date for
f~lingthe record be extended to
February
22, 1993.
The Board notes that Central Can has submitted a 30-day
waiver of the decision deadline, so that a decision in this case
is now due on May 23, 1993. In that waiver, Central Can makes
reference to discussions between the Agency, USEPA, and Central
Can, and states that USEPA needed
an
additional 30 days (from
December 28, 1992) to review the matter. Central Can states that
the~ediscussions are aimed at resolving this matter without
prolonged litigation. The Agency’s motion for extension .of time
is granted, and the record is due on February 22, 1993.
