THE BOARD

On January 15, 1993, the parties filed, a joint status report
in accordance with the Board’s order of
December
17, 1992. They
report that after a series of discussions, Safety—Kleen and the
Agency reached agreement on how to resolve all of the issues raised
in the above-captioned appeal. In order to memorialize
the
understandings of the parties and to resolve
the
disputed
permit
conditions giving, rise to this appeal,. the Agency asked Safety—
Kleen
to
submit a modified permit application. During October,
1992, Safety-Kleen did so. The application incorporated changes and
ir~forination supporting the ~understandings of the parties.
On
January
7,
1993 the Agency issued a permit, which was
received by Safety-Kleen on January 11, 1993. Safety-Kleen asserts
that once it has had an opportunity to review the permit, it
anticipates that it will file a motion to voluntarily withdraw the
permit appeal.
The parties are directed to file an updated status report on
or
before April 16, 1993 in the event this appeal has not been
dismissed.
