This petition was filed with the Board on July 13,
1990.
On
May 4,
1992, the Board received a status report filed on behalf of
petitioner Marathon Petroleum Company.
The status report indicates
that
petitioner
filed
a
no
migration
petition
with
the US.
Environmental Protection Agency
(USEPA)
in 1989, and is currently
waiting
for the USEPA to act on the petition.
Petitioner also
filed a no migration petition with the Board in July of 1990.
The
regulations adopted by the Board contain a parallel procedure to
the
rules
promulgated
by
the
USEPA
regarding
a
no
migration
petition.
For
this
reason,
the status report
indicates that a
hearing would not be productive at this time.
The
Board
directs
the Marathon
Petroleum
Company to
file
another status report with the Board to be received by the Board no
later than September 1,
1992.
