ORDER OF THE BOARD (by J. Anderson):
On June 16, 1992, the Agency moved for leave to file its
“answer” instanter; this is the Agency’s record in this permit
appeal. Counsel for the Agency states he was employed and
assigned this case by the Agency in February, 1992 and has
diligently sought to inform himself about this case.
The Board notes that, even calculating from the date of
consolidation of these cases, rather than the date of the filing
of PCB 92-2, this record is over three months late.
The Board is concerned about the significant delay in filing
this record. The Board also notes with concern the absence of
any earlier motion requesting an extension of time. However,
because the Act requires the Boar to consider the record in
rendering its decision, the Agency’s motion to allow filing of
the Agency record instanter is hereby granted.
