ILLINOIS POLLUTION CONTROL
    BOARD
    May 7,
    1992
    GENERAL ELECTRIC
    COMPANY,
    Petitioner,
    PCB 90—244
    v.
    )
    (Permit Appeal)
    ILLINOIS ENVIRONMENTAL
    PROTECTION AGENCY,
    Respondent.
    ORDER OF THE BOARD
    (by M. Nardulli):
    This matter
    comes
    before the Board
    on
    a
    joint motion
    for
reconsideration and extension of hearing date filed on May 5, 1992.
    By the instant motion,
the parties ask that the Board reconsider
its decision of April 9, 1992 directing the hearing officer to set
    this matter for hearing.
The order directed the hearing officer to
schedule this matter for hearing by May 11, 1992, and to finish all
    hearings by July 15,
    1992.
This petition was filed with the Board on December 26,
    1990.
The parties assert that they have been working together since the
    filing
    of
    the
    petition
    in
    order
    to
    resolve
    this
    matter.
    Specifically,
    the
    parties have engaged
    in
    settlement
    telephone
    conferences and meetings on January
    11,
    1991 and on January
    16,
    1992.
    Additionally,
    General Electric Company
    (GE)
    conducted a
    technical investigation and issued
    a revised draft work plan
    on
    August
    28,
    1991.
    The
    Illinois Environmental
    Protection Agency
(Agency) responded to the draft work plan with comments on January
    15,
    1992,
and GE submitted a technical response to the Agency’s
    written comments on March
    18,
    1992.
    The parties have scheduled
    another settlement meeting
    for June
    1,
    1992.
    Finally,
    GE has
    recently hired
    a
new environmental manager and GE believes his
input will be essential in the upcoming settlement negotiations.
For these reasons, the parties assert that scheduling a hearing in
this matter would not promote settlement.
    The Board hereby grants
    the parties’ motion to reconsider.
    Upon reconsideration,
the Board vacates the Board’s April
    9,
    1992
    order.
    Additionally,
    the Board
    directs the parties
    to
    file
    a
status report with the Board to be received by the Board no later
    than June 30,
    1992.
The Board notes that the June 30,
    1992 date
will allow the Board the time necessary to hold a hearing prior to
the December 31, 1992 decision deadline, if a hearing is necessary.
    IT IS SO ORDERED.
