ORDER OF THE BOARD (by G.T. Girard):
On June 15, 1992 the parties filed a status report as directed
by the Board’s order of April 23, 1992. The parties report that
they have tentatively scheduled Monday, June 22, 1992 for a meeting
in Springfield to discuss certain conditions contained in the
IEPA’s Closure Plan Approval. The purpose of the meeting is to
consider and address IEPA’s concerns with respect to the Closure
Plan and any further evaluation of the site, with the hope that the
pending issues between the parties could be resolved and any need
for a hearing be obviated. The parties anticipate that the review
and analysis necessary for their settlement discussions will take
approximately three months. Accordingly, the parties request that
the hearing date be continued beyond the week of August 24.
The Board notes that the decision date in this matter is
presently October 31, 1992. Absent an additional waiver of the
decision deadline, the Board cannot allow postponement of hearing
through August 24, as this would unacceptably truncate times for
briefing and Board deliberation in this matter. Based on this
deadline, the hearing officer is directed to schedule hearing on or
before July 15 and to complete hearings by August 15, 1992.
However, the hearing officer is authorized to modify this schedule
by order in the event that an additional waiver is received.
