the parties
filed what purports
to be a
status report as directed by the Board’s order
of April 23,
1992.
This filing states only
that “the
status is that the Petitioner
and
Illinois
Environmental
Protection
Agency
are
continuing
discussions to try to resolve this matter”.
This
filing
is
unacceptable.
The parties have
failed
to
indicate what actions have been taken,
or progress made,
toward
resolution of this action, and have failed to provide an estimated
date for the completion of this proceeding.
If an adequate amended status report
is not received by the
Board on or before July
7,
1992,
this matter will be subject to
dismissal.
The Board also notes that, absent waiver of the current
October 30, 1992 decision date, the Board may order this matter to
hearing to avoid truncation of the Board’s time for post—hearing
deliberation and decision in this matter.
