ORDER OF THE BOARD

On
June
15,
1992,
the
parties
filed
a
status
report
as
directed by the Board’s order of April
9,
1992.
The parties report
that this matter
is an appeal by Olin of the decision by IEPA to
deny the incinerator portion of Olin’s application for a RCRA Part
B Hazardous Waste Management Permit for Olin’s Main Plant facility
in
East
Alton,
Illinois.
Pursuant
to
the
negotiations,
Olin
conducted
a
trial
burn
of
its
hazardous
waste
incinerator
on
December 18,
1991 and submitted a report of the results to IEPA on
March 13, 1992.
Both parties expect that any remaining issues will
be
resolved
by
mutual
agreement,
once
information
from
the
incinerator trial burn is analyzed by IEPA.
When IEPA has reviewed
the
trial
burn
data,
a
draft
permit
will
be
issued
for
the
incinerator.
Both parties expect that this draft permit may be
acceptable to Olin,
leading to the issuance of a final permit and
dismissal of this appeal.
Based on this belief, the parties have
not initiated discovery in connection with this matter.
On May 15,
1992, the parties held a joint conference call with
the Hearing Examiner in this matter, but a final schedule for the
resolution of the matter could not be determined because IEPA had
not yet had
sufficient
time
to
review the
trial
burn
results.
Accordingly,
the
parties
report
that
the
status
has
remained
unchanged since the May conference call.
The parties are directed to file an updated status report on
or before September 15,
1992.
The updated report shall contain an
estimated date for the completion of this matter.
