CONCURRING OPINION (by

I concur in the Board’s order simply to remind the parties,
and the public, that Section 42(f) of the Environmental
Protection Act (Act) provides that the Board may award costs and
reasonable attorney’s fees in cases brought in the name of the
people of the State of Illinois. (Ill.Rev.Stat. 1991, ch. 111½,
par. 1042(f).) I urge the parties to keep this provision in mind
when negotiating and presenting any stipulation in this case.
