    ORDER OF THE BOARD (by C.A. Manning):
     
    On April 22, 2002, the parties timely filed a joint notice to extend the 35-day period
    within which Shearon, Inc. (Shearon) may appeal a March 18, 2002 determination of the
    Illinois Environmental Protection Agency (Agency).

    415 ILCS 5/40(a)(1) (2000); 35 Ill.
    Adm. Code 105.206(c), 105.208(a), (c). The Agency rejected the high priority corrective
    action plan budget regarding Shearon’s facility 101 Ratzlaff Street, Harvard, McHenry
    County. Since the record does not specify the date on which the Agency’s determination was
    served on the petitioner, the Board will calculate the extension from the date of the Agency’s
    determination. The Board extends the appeal period until July 21, 2002, as the parties request.

    appeal on or before that date, the Board will dismiss this case and close the docket.
