ORDER OF THE BOARD
(by N. Nardulli):
This petition was filed with the Board on Septem~ber20,
1991.
On April
16, 1992, the Board received a status report filed by the
Illinois Environmental
Protection Agency
(Agency).
The
status
report indicates that the petitioner and the US.
EPA are working
to resolve this matter.
Petitioner is currently negotiating limits
of the Federal Implementation Plan
(FIP)
promulgated by the U.S.
EPA at 55 Fed. Reg.
26814 on June 29,
1990.
The rules adopted by
the Board are substantially similar to the rules promulgated by the
U.S.
EPA.
The parties
asserted that
once
the
issues
between
petitioner and the U.S. EPA are resolved through the issuance of a
letter
notice,
the
Agency
will
modify
petitioner’s
permit
to
reflect those limits.
The Board orders a stay of the proceedings in this matter for
90 days from the date of this order,
and directs the parties to
file another status report with the Board to be received by the
Board
no
later
than August
1,
1992.
The
Board
notes
that
a
previous order on February 6, 1992 granted an extension of the time
in which the Agency was to file its recommendation until May
15,
1992.
The Agency may renew its request if necessary, when the next
status report is filed.
IT IS SO ORDERED.
I,
