ORDER OF THE BOARD (by G.T. Girard):

On July 22, 1992, the parties filed an agreed motion to modify

the Board’s order of May 7, 1992 directing that hearing in this

matter be scheduled by June 30, 1992 and completed by September 3,

1992. The parties state that on June 29, 1992, after consultation

with counsel for Douglas Furniture and the Agency regarding

availability, the hearing officer issued a notice of hearing and

hearing officer scheduling order. Through inadvertence the hearing

date was set for October 13, 1992, with final briefs to be filed on

December 22, 1992. A waiver of decision has been filed in this

matter to and including February 4, 1993.

The parties state that they continue to diligently pursue

settlement in this matter and it appears unlikely that the matter

will go to hearing. However, the parties request and move the

Board to modify its May 7, 1992 order to. allow hearings to be

completed by October 16, 1992, in order to reconcile the notice of

hearing and hearing officer scheduling order.

The parties’ motion to allow completion of hearing on or

before October 16, 1992 is hereby granted.
