On July 28,
1992, the parties filed a “Joint Petition to
Discontinue Monitoring.”
The petition requests that the Board
temporarily discontinue field monitoring procedures as required
in the Board’s April 25,
1991 order.
In its April 25,
1991
interim order the Board mandated that respondent retain
independent consultants to monitor concert performances at two
locations.
This procedure has been followed during the 1991 concert
season and the 1992 concert season to date.
The Village of
Natteson and World Music Theatre (Theatre) agree that the current
procedure is not producing results which will help resolve the
dispute.
The parties note that negotiations a~ecurrently
proceeding between the parties.
The parties believe that so lonç
as good-faith is exhibited by the parties in these negotiations,
Theatre should realize certain savings associated with the
discontinuing of the monitoring and that those savings can be
applied to potential capital expenditures which may permanently•
resolve the issues in the pending complaint.
The Board hereby grants the request of the parties and
discontinues the requirement for continuous monitoring.
All hearings have been completed in this matter.
The
hearing officer’s order mandates final briefs to be submitted to
the Board by September 18,
1992.
Unless a settlement agreement
or other appropriate motion
is filed in this matter before that
date, the Board will proceed to review the record in this matter
and make its determination based on the merits of the case.
