On September 3,
1992,
the Agency moved for an extension of
time in which to file its record.
The record was due on August
31,
1992 and the Agency seeks an extension to October 31,
1992.
The Agency states that:
the Agency is engaged in serious negotiations with
Ethyl Petroleum.
We have spoken more than four times
and believe that we will be able to resolve the issues
that lead to the permit appeal being filed.
Therefore,
assembly and submittal of the record at this time would
entail the unnecessary use of scarce resources.
Petitioner has waived the decision date indefinitely
and has agreed to extend the deadline for filing of the
record until October 31,
1992.
The motion is granted.
The record is due to be filed on or
before October 31,
1992.
