    ORDER
    OF THE
    BOARD
    (by G.T. Girard):
    On May 22,
    1992,
    LTV Steel filed its fifth status report
    in
    this case,
    a waiver of the decision date until January 1,
    1993, and
    an agreed motion for an additional 90 day stay of this proceeding.
    This filing was made in response to the Board’s order of April
    9,
    1992, which stayed this permit appeal through May 25, 1992 pursuant
    to the parties motion of March 16,
    1992.
    As explained in the previous order, the parties state that the
    sole
    remaining
    issues
    in
    this
    Permit
    Appeal
    is
    the
    thermal
    limitations
    required
    by
    the
    Draft
    Permit.
    LTV
    has
    agreed
    to
    perform
    a
    thermal
    study
    of
    a
    section
    of the Calumet River,
    in
    conjunction with Acme Steel Company,
    a neighboring steel facility
    that has
    a similar permit appeal pending before the Board.
    LTV
    asserts that the results of the thermal
    study will provide the
    basis for an adjusted standard petition that LTV and Acme Steel
    intend to file to adjust the thermal limitations currently set in
    their permits that are on appeal.
    The parties now report that a contractor,
    EA Engineering, has
    been selected to perform the study,
    and that the contract is being
    finalized between
    EA,
    LTV,
    and Acme.
    The parties state that as
    soon as the contract is finalized, EA Engineering will be able to
    draft a timetable for performing the thermal study.
    At that point
    in time,
    LTV
    Steel asserts that it will be in a better position to
    give the Board sufficient information to allow it to determine the
    anticipated date for conclusion pf this action.
    As the parties are continuing to show adequate progress
    in
    bringing this matter to a resolution,
    the motion for stay for 90
    days
    is
    granted
    through
    September
    5,
    1992,
    at which
    time
    the
    parties are directed to file
    a status report.
    In the event the
    parties
    wish
    to
    seek
    an
    additional
    stay,
    any motion
    must
    be
    accompanied
    by
    an
    appropriate
    waiver
    of
    the
    Board’s
    decision
    deadline and information sufficient to allow the Board to determine
    the anticipated date for conclusion of this matter.
