ORDER OF THE BOARD
(by J.C. Marlin):
On June 29, 1992, the Agency moved for an extension of time in
which to file its record in this matter.
The record was orginally
due to be filed May 8, 1992; the Board granted an extension through
June 3O,~ 1992 by order of May 21,
1992.
The Agency now seeks an
extension through August 31, 1992.
The Agency’s affidavit asserts
that petitioner has agreed to the extension, but provides no reason
for seeking a further extension other than that it was “unable to
file the record by June 30,
1992.”
The Board notes that on May 18,
1992 petitioner filed an open
waiver of the Board’s decision deadline,
citing the pendency of
settlement negotiations.
Because the Act requires
the Board to consider the Agency
record in its deliberations, the Agency’s motion for extension of
time
in
which to file
its record
is granted through August
31,
1992.
No further extensions will be granted where no reason for
the delay is given.
