On September 15, 1992,
R. Lavin
& Sons, Inc.,
(Lavin)
filed
a status report and waiver of decision date.
Lavin’s report
states that it is continuing discussions with the Illinois
Environmental Protection Agency (Agency) concerning this permit
appeal and that it is also negotiating with the North Shore
Sanitary District (Sanitary District) and the City of North
Chicago (City).
As part of these negotiations, Lavin has hired
consultants to investigate the extent of any impacts Lavin’s
effluent may have on the City’s stormwater sewer line and the
Sanitary District’s wastewater treatment facility.
The Sanitary
District and the City have informed Lavin that they would not be
able to make any determinations on the information until the end
of 1992.
Lavin requests that the Board set the matter. for
another status report in late January or early February,
1993.
Lavin has supplied the Board with a waiver of the final decision
deadline in this matter until June 30, 1993.
On September 15,
1992, the Agency filed its status report,
which states,
inter
alia,
that Lavin is exploring the feasibility
of transporting its stormwater to the Sanitary District’s
wastewater treatment facilities.
The Board hereby orders that the parties submit status
reports to be received by the Board on or before February 1,
1993.
