ORDER
OF THE
BOARD

On December 14,
1992, the Concerned Citizens of Williamson
County filed what appears to be a third party appeal of a
November 10,
1992 decision of the Williamson County Board
granting site location suitability approval for a new regional
pollution control facility.~ This petition is deficient.
Section
40.1(b)
of the Act requires that the person filing the appeal be
one who “participated in the public hearing conducted by the
county board”, and requires the Board to find that “the
petitioner is so located as to..
be affected by the proposed
facility”.
This petition does not address these issues.
Additionally, the petition does not specify any grounds upon
which the appeal is sought.
Petitioner is directed to file an amended petition curing
these deficiencies within 45 days of the date of the Order, or
this petition will be subject to dismissal.
The filing of an
amended petition will restart the Board’s decision timeclock
pursuant to Section 40.1 of the Act; however, the Board will use
the December 14 date of the filing of the original petition for
the purpose of determining any issues relating to timeliness of
filing of the petition for review.
Finally, the Board directs the parties attention to an order
which
it adopted today dealing with Section 40.1(b) and other
issues.
